By accessing or using SpinWheelify (available at https://spinwheelify.com) or our mobile applications, you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you must not access or use our services. These Terms constitute a legally binding agreement between you and SpinWheelify.

SpinWheelify provides free online and mobile tools for random selection and decision-making, including but not limited to:

• Customizable spin wheels for random selection
• Name pickers and random group generators
• Yes/No decision wheels and random number generators
• Shareable wheel templates and presets

The service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.

You must be at least 13 years of age to use SpinWheelify. If you are between 13 and 18 years of age (or the applicable age of majority in your jurisdiction), you may only use the service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using the service, you represent and warrant that you meet the eligibility requirements above. We do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided personal information, we will delete it promptly.

Some features of SpinWheelify may require you to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your credentials confidential and not share them with others
• Notify us immediately of any unauthorized use of your account
• Be solely responsible for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe may pose a security risk.

You retain ownership of all content you create or input into SpinWheelify ("User Content"), such as wheel labels, custom lists, and configurations. By using the service, you grant SpinWheelify a limited, non-exclusive, royalty-free license to display and process your User Content solely to provide the service to you.

You are solely responsible for your User Content. You represent and warrant that your content does not and will not:

• Violate any applicable local, national, or international law or regulation
• Be defamatory, obscene, abusive, threatening, hateful, or harassing
• Promote discrimination based on race, ethnicity, gender, religion, disability, age, or sexual orientation
• Contain adult, explicit, or pornographic material of any kind
• Include personal data of third parties without their consent
• Infringe upon the intellectual property rights of any third party
• Constitute spam, misleading information, or fraudulent content

We reserve the right (but not the obligation) to review, remove, or disable access to any User Content that we determine, in our sole discretion, violates these Terms.

You agree not to engage in any of the following activities:

• Using the service for any unlawful purpose or in violation of any regulations
• Attempting to gain unauthorized access to any part of the service or its systems
• Using automated scripts, bots, scrapers, or crawlers to access the service
• Reverse engineering, decompiling, or disassembling any part of the service
• Interfering with or disrupting the integrity or performance of the service
• Circumventing, disabling, or otherwise interfering with security features
• Impersonating another person or entity
• Using the service to send spam or unsolicited commercial communications
• Commercially exploiting any part of the service without our written consent
• Using the service in connection with gambling, wagering, or betting activities

Violation of these prohibitions may result in immediate termination of your access and may be reported to relevant authorities.

All content, features, and functionality of SpinWheelify — including but not limited to text, graphics, logos, icons, images, software, and the overall design — are owned by or licensed to SpinWheelify and are protected by copyright, trademark, patent, trade secret, and other applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service for your personal, non-commercial use only. You may not copy, reproduce, distribute, create derivative works, publicly display, or exploit any content from the service without our express written permission.

The SpinWheelify name, logo, and related marks are trademarks of SpinWheelify. Nothing in these Terms grants you the right to use our trademarks.

SpinWheelify uses third-party services to operate and improve the platform, including but not limited to:

• Google AdSense / Google AdMob: We display advertisements served by Google and its partners. These services may use cookies and similar technologies to serve ads based on your prior visits to our website or other websites. You can learn more and opt out at Google Ads Settings.
• Google Analytics: We use Google Analytics to understand how visitors use our site. Data is anonymized and used only for improving the service.
• Other third-party tools: We may integrate additional services for functionality such as authentication, performance monitoring, or customer support.

We are not responsible for the privacy practices or content of third-party services. Your interactions with third-party services are governed by their respective terms and privacy policies.

Our service may contain links to external websites. These links are provided for convenience only. We do not endorse and are not responsible for the content or practices of any linked sites.

Your use of SpinWheelify is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our service, you consent to our collection and use of information as described in our Privacy Policy.

We comply with applicable privacy laws including the General Data Protection Regulation (GDPR) for users in the European Economic Area, and the California Consumer Privacy Act (CCPA) for California residents.

SpinWheelify may be available as a mobile application on the Google Play Store or other platforms. Your use of the mobile app is also subject to:

• The Google Play Developer Distribution Agreement and applicable platform policies
• The terms of the applicable app store through which you downloaded the app
• These Terms of Service

The app may request device permissions (such as internet access or storage) necessary to provide core functionality. We do not use these permissions for any purpose beyond operating the service. We comply with Google Play's policies on ads, user data, and content, including restrictions on advertising to children.

We may release updates to the app. Depending on the update, you may not be able to continue using the app until you update to the latest version.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that: (a) the service will be uninterrupted or error-free; (b) any results or outcomes produced by the service will be accurate or reliable; (c) the service will meet your requirements; or (d) defects will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPINWHEELIFY, ITS OWNERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Costs of substitute goods or services
• Damages resulting from unauthorized access to or alteration of your content
• Any other damages arising from your use of or inability to use the service

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, the limitations above apply to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless SpinWheelify, its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of or access to the service
• Your violation of these Terms
• Your User Content
• Your violation of any third-party rights, including intellectual property rights

We reserve the right to suspend or terminate your access to the service, with or without notice, for any reason, including if we believe you have violated these Terms, applicable laws, or third-party rights.

You may discontinue use of the service at any time. If you have an account, you may request deletion by contacting us at [email protected].

Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

To the extent permitted by law, you waive any right to participate in a class-action lawsuit or class-wide arbitration against SpinWheelify.

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For significant changes, we may notify you through the service interface or via email.

Your continued use of SpinWheelify after changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the service.
